What does “owning your data” actually mean?

What happens if you cancel or leave?

You leave with everything. Your GHL account stays yours. Your Netlify domain and all its pages stay yours. Your email sequences, automations, lead lists, and customer contact history stay yours. The only thing that stops is new support: we no longer make changes or push updates. But your system continues running on your own accounts, and another agency can take over maintenance if needed.

This is why vendor lock-in is essentially impossible when the core infrastructure belongs to you. Second, get a clear handover timeline: what gets delivered, when, and in what format. Third, ask for an export guarantee: all your data (contacts, leads, orders, content) must be exportable to standard formats (CSV, JSON) within 30 days of request. Fourth, confirm no proprietary dependencies: the website is built on Astro or Next.js, not a custom framework only they understand. The AI agent uses standard API calls, not black-box internal tools. Fifth, request written confirmation that you can migrate to a new provider or run the system yourself without restrictions.

If an agency resists writing these down, that is a warning sign. Clear portability is not a risk to them, only to you.

Real situation: the “can I download my brain?” question

How to check a contract for lock-in risk

Read the contract or proposal for these three sections.

First, find the ownership clause. It should explicitly state: “All data, content, systems, and AI agents built under this engagement are owned by [your company] and shall remain so upon termination or cancellation.” If it says “The Agency retains ownership of templates” or “licensing” instead of ownership, push back and negotiate to clarify what you own.

Second, find the data and termination section. Look for: “Upon request, all customer data shall be provided in standard CSV/JSON format within 30 days.” If it says “data provided at sole discretion of The Agency” or “not applicable” you have a portability problem.

Third, look for restrictions on migration. The contract should NOT include: “You agree not to use The Agency’s proprietary tools with another vendor” (illegal, unenforceable), “system access restricted to The Agency staff” (means you do not have real access), or “migration support requires additional payment” (financial lock-in). If these appear, request removal before signing.

A 50-year-old law firm or accounting partnership did not survive this long by handing control to outside vendors. That caution is wisdom, not paranoia.
