By accessing or using the services provided by The Agency ("we", "our", "us") at theagency.io, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms constitute a legally binding agreement between you and The Agency.
The Agency provides AI-powered marketing and business systems, including but not limited to: website development, AI sales agents, CRM automation, content engines, lead generation, and associated deliverables. Services are delivered as described on our website and in your chosen tier. We reserve the right to modify, update, or discontinue any feature with reasonable notice.
We offer three tiers:
Prices are in US dollars and do not include applicable taxes. We reserve the right to adjust pricing with 30 days written notice. Any price changes will not affect your current billing cycle.
Monthly tiers (AI Company On Autopilot and Full AI Business System) require a minimum 6-month commitment. During this period, the website and brand kit remain the property of The Agency. If you cancel before the minimum period, you keep all documents, content, and deliverables we created, but website hosting and AI agent access will end after 30 days notice. The one-off tier (AI Company Upgrade) has no minimum commitment.
Subscriptions are billed monthly in advance. Payments are processed securely through Stripe. You are responsible for keeping your payment method up to date. If a payment fails, we will attempt to charge your payment method again within 7 days. If payment continues to fail, your account may be suspended until payment is received. You may upgrade or downgrade your tier at any time, with billing adjusted pro-rata.
You may cancel your subscription at any time by emailing hello@theagency.io or through your CRM dashboard, with 30 days written notice. Upon cancellation: your website will remain live for 30 days after the end of your notice period; you retain all deliverables, documents, and content created during your subscription; access to AI agents, CRM, and automated systems will end after the notice period. We do not offer refunds for the current billing period after the 14-day trial.
Your content: You retain full ownership of all content, images, brand assets, and business data you provide to us. You grant us a licence to use this content solely for the purpose of delivering our services.
Our work product: All deliverables created for you (website, content, Company Brain, AI prompts, sales materials) become your property upon payment. You may use them without restriction.
Our platform: The Agency's underlying technology, systems, processes, templates, and AI models remain our intellectual property. You receive a licence to use these systems during your subscription, not ownership of the technology itself.
You agree not to use our services to:
Our services integrate with third-party platforms including Instagram, Facebook, YouTube, TikTok, LinkedIn, GoHighLevel, Netlify, Google, and others. We are not responsible for changes to third-party APIs, terms of service, or platform policies that may affect service delivery. We will make reasonable efforts to adapt to platform changes, but cannot guarantee uninterrupted service if a third-party platform makes breaking changes.
To the maximum extent permitted by law, The Agency's total liability for any claim arising from or related to these terms or our services shall not exceed the total amount you have paid to us in the 3 months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, regardless of the theory of liability.
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee specific results, lead counts, revenue increases, or search engine rankings. While we have a proven track record with 32,000+ brands, individual results depend on factors outside our control, including your industry, content quality, audience, and market conditions.
You agree to indemnify and hold harmless The Agency, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your violation of these terms, or your violation of any third-party rights.
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
We may update these terms from time to time. Material changes will be communicated via email to active subscribers with at least 30 days notice. Continued use of our services after changes take effect constitutes acceptance of the updated terms. If you do not agree with the changes, you may cancel your subscription.
